Terms of Service
These Terms of Service ("Terms") are an agreement between you and Zeljko Mijatov, an individual developer based in Serbia, operating BestDiveBuddy ("BestDiveBuddy", "we", "us"). By creating an account or using the app or website, you agree to these Terms. If you don't agree, please don't use BestDiveBuddy.
BestDiveBuddy helps divers find each other for planned dives — it does not verify anyone's certification, experience, or identity, does not organize or supervise any dive, and is not a dive operator, dive school, or certifying agency. You are solely responsible for verifying a potential buddy's qualifications, diving only within your own training and experience limits, and using a licensed dive operator or instructor where appropriate. We strongly recommend meeting new buddies in a public place first, and never diving beyond what you and your buddy are both trained and equipped for.
1. Eligibility
- You must be at least 18 years old to use BestDiveBuddy.
- You may only create and use one account.
- The information you provide (including your date of birth, certification details, and contact information) must be accurate and kept up to date.
- You're responsible for keeping your account credentials secure, and for everything that happens under your account.
2. What BestDiveBuddy is (and isn't)
BestDiveBuddy is a matching and communication tool: it suggests compatible dive buddies based on the preferences and plans you provide, and lets you chat, propose, and confirm a dive together. We don't guarantee that any match will be compatible, reliable, or safe to dive with, and we don't guarantee you'll find a buddy at all. Any decision to meet, dive, or otherwise interact with another user is entirely your own, at your own risk.
3. Acceptable use
To keep BestDiveBuddy safe and usable for everyone, you agree not to:
- Harass, threaten, stalk, or abuse another user.
- Post or send content that is sexually explicit, hateful, discriminatory, violent, or otherwise objectionable.
- Impersonate another person, or misrepresent your identity, age, or diving qualifications.
- Use the app to advertise, solicit, or sell unrelated goods or services, or to run scams or off-platform payment schemes.
- Attempt to bypass a block, evade an account suspension, or create more than one account.
- Attempt to interfere with, reverse-engineer, or abuse the app or its infrastructure.
- Use the app for anything illegal under the laws that apply to you.
4. Reporting, blocking, and enforcement
You can report or block another user directly from their profile or your chat with them — blocking immediately stops all future matching and messaging between you and that person. We review reports and may warn, suspend, or permanently remove any account that violates these Terms, at our discretion, with or without notice, particularly where we believe there's a safety risk. 5. Your content
You keep ownership of the content you post or send (profile information, messages, photos, ratings, reports). By posting it, you give us a license to store, display, and process it as needed to operate the service — for example, showing your profile to a compatible match, or delivering your chat messages to the person you're messaging.
6. Account deletion and termination
You can delete your account at any time — see how. We may suspend or terminate your account if you violate these Terms, pose a safety risk to other users, or if required by law. Some anonymized records may be retained after deletion as described in our Privacy Policy.
7. Disclaimers
BestDiveBuddy is provided "as is" and "as available," without warranties of any kind, express or implied, including any warranty that the service will be uninterrupted, error-free, or that any match will be safe, compatible, or suitable for diving together. We do not conduct background checks on users and do not verify certifications, insurance, or equipment.
8. Limitation of liability
To the maximum extent permitted by law, BestDiveBuddy and Zeljko Mijatov will not be liable for any indirect, incidental, special, or consequential damages, or for any injury, death, loss, or damage arising from or related to: your use of the app, any interaction or dive with another user you met through the app, or any diving activity itself. Nothing in these Terms limits any liability that cannot legally be limited or excluded in your jurisdiction.
9. Indemnification
You agree to defend and indemnify us against any claim, loss, or damage (including reasonable legal fees) arising from your misuse of the app, your violation of these Terms, or your interactions with other users.
10. Changes to these Terms
We may update these Terms from time to time. If we make a material change, we'll update the date at the top of this page and, where appropriate, let you know in the app. Continuing to use BestDiveBuddy after a change means you accept the updated Terms.
11. Governing law
These Terms are governed by the laws of Serbia, without regard to conflict-of-law principles. This doesn't take away any mandatory consumer-protection rights you may have under the law of the country where you live, where those rights can't be waived by agreement.
